Terms & Conditions for Purchasing Original Artwork from the Luke O'Neil Website

Introduction

Welcome to my original artwork website “Luke O'Neil” These Terms & Conditions govern the purchase of artwork from me, whether online or in person. By purchasing from me, you agree to the following terms.

Purchasing Artwork

Consider Before You Buy: I encourage customers to carefully consider their purchase before committing, as original artworks are unique and valuable. If possible, I recommend viewing the artwork in person before purchasing.

Delivery & Returns: Due to the nature of my operations, arranging insured deliveries of artworks is both expensive and time-consuming. I am happy to include the cost of delivery across mainland UK within each artwork price on my site to prevent customers incurring an additional amount for secure packaging, postage and insurance.

I reserve the right to reclaim these costs should a customer decide against keeping a piece of art they have purchased which they have not seen in person. Whilst I am happy to issue refunds in accordance with standard retail regulations, I also reserve the right to charge for any costs incurred in both the delivery and the return process, including all initial delivery costs, insurances, collections, and safe transportation.

Refunds & Returns: If you are unhappy with your purchase, you have the right to return the artwork within 30 days under the UK’s Consumer Contracts Regulations. However, you will be responsible for return costs, and I require that the artwork be returned via an approved courier to ensure it arrives undamaged. Refunds will only be issued once the artwork is received in its original condition.

Delivery outside the UK

Shipping Costs: Collection from my studio is free, but I am happy to provide a bespoke insured delivery quote for delivery outside the UK for each piece sold. Please email studio@lukeoneil.co.uk or call me on 07722587149 to arrange a quote. These costs will vary depending on the size, weight, and destination of the artwork. Free delivery for artwork is only available across mainland UK.

Delivery Times: I aim to dispatch all orders within 3 to 5 days of purchase with fully insured, tracked delivery across the UK. Please be aware that due to the specialist nature of art shipping, delivery times may vary. Estimated delivery times will be provided at the time of purchase in a follow up email.

Damaged or Lost Items: If an artwork arrives damaged, you must notify me within 48 hours of receipt, providing photographs of the damage. I will work with you to resolve the issue, either through a refund or replacement if possible.

Ownership & Copyright

Ownership of Artwork: Ownership of an artwork transfers to the buyer only once full payment has been received and cleared.

Copyright & Reproduction: Purchasing an artwork does not grant the buyer any reproduction rights. The copyright of all artworks remains with me unless otherwise stated.

Liability

Accuracy of Information: I make every effort to ensure that artwork descriptions, dimensions, and images are accurate. However, slight variations in colour or texture may occur due to screen differences and photography. Wherever possible, I recommend viewing the artwork in person.

Limitation of Liability: I am not responsible for any indirect or consequential loss arising from your purchase, including delays in delivery or courier issues beyond my control.

Privacy & Data Protection

Customer Data: I respect your privacy and handle your personal information in accordance with my Privacy Policy, which outlines how I collect, use, and store data securely.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
